Terms & Conditions

Last updated 28 May 2026. These terms form a binding contract between you and FlyRada Ltd.

1. Definitions

“Services” means the cloud, bare-metal, Kubernetes, security and professional services provided by FlyRada. “Customer” means the entity that opens an account. “Order Form” means any signed quote, online checkout or written purchase confirmation referencing these terms.

2. Service provisioning

Cloud VPS resources are provisioned within 60 seconds of payment authorisation. Bare-metal servers are provisioned within 4 business hours for stock SKUs and within 5 business days for custom builds. Managed Kubernetes clusters are provisioned within 24 hours after kickoff.

3. Service Level Agreement

  • Network availability: 99.99% measured monthly, per datacenter.
  • Power availability: 100% measured at the PDU.
  • Control-plane availability (Managed K8s): 99.95%.
  • Remedy: service credits of 10% (per hour of downtime) up to 100% of the monthly fee for the affected service. Credits must be claimed within 30 days via the support portal.

4. Fees & billing

All prices are in Euros, exclusive of VAT. Recurring fees are billed monthly in advance; usage fees (egress overage, snapshots) are billed monthly in arrears. Invoices are due within 14 days. Late payments accrue interest at 4% above the Bank of England base rate per the Late Payment of Commercial Debts (Interest) Act 1998.

5. Acceptable Use Policy

You will not use the Services to send spam, host malware, conduct unauthorised port scans, run open SMTP relays, mine cryptocurrency on shared resources, or host content that infringes third-party rights or violates UK/EU law. We will suspend offending workloads with reasonable notice; egregious abuse (CSAM, active C2, ongoing DDoS reflection) is suspended immediately.

6. Customer obligations

You are responsible for securing your operating systems, applications, and credentials above the hypervisor for VPS, or above the BIOS for bare-metal. You must keep contact and billing information current. You are responsible for taking and verifying backups unless you have purchased our Managed Backup add-on.

7. Intellectual property

You retain all rights to your data and content. FlyRada retains all rights to its platform, documentation and trademarks. You grant us a limited licence to process your data only as necessary to provide the Services.

8. Confidentiality

Each party will protect the other's confidential information with at least the same care as its own, for a period of 5 years after disclosure.

9. Liability

To the maximum extent permitted by law, each party's aggregate liability under these terms is capped at the fees paid in the 12 months preceding the claim. Neither party is liable for indirect, special, or consequential losses, including loss of profit or data, except for breaches of confidentiality, IP infringement, or data-protection obligations.

10. Term & termination

Monthly contracts auto-renew until cancelled with 7 days' notice. Annual contracts auto-renew unless cancelled 30 days before renewal. Either party may terminate for material breach uncured within 30 days, or immediately on insolvency of the other.

11. Data protection

Our Data Processing Addendum, incorporating EU and UK Standard Contractual Clauses, is incorporated by reference and available at /privacy.

12. Governing law

These terms are governed by the laws of England and Wales. The courts of London have exclusive jurisdiction, save that we may seek injunctive relief in any competent court.
